This information provides transparency and clarity around the principles we will apply to your registration with us for work seeking services. You will need to acknowledge you have read and understood these to continue your registration process.

Intelligent Resource offers interim, contract and permanent roles across a broad range of disciplines from IT to Finance and Accounting, Operational, HR, Procurement and Sales and Marketing across all industry sectors in the UK.

We operate as both an Employment Agency and Employment Business as defined by The Conduct Regulations 2003 and Conduct Regulations (Amendment) 2010. We also adhere to BEIS conduct and guidance.

Conduct Regulations

We do not charge candidates for work-seeking services and all of our roles offer rates higher than the national minimum wage.

Terms and Conditions relating to the specific role and client will be made visible to you prior to commencing any assignment, including notice period requirements.

During the process of finding you work we will ask you whether it is your intention to opt out of the Conduct Regulations.

We will make appropriate adjustments and provide support (for example, assistive technology, extra time or materials in alternative format) for candidates who have a disability or long-term condition. Please see our Diversity and Inclusion page for further information.

Once you have registered

By registering with us and providing details of your background and experience, you will actively be considered for all relevant existing and future positions across our client base. This means we will:

  • Proactively explore opportunities on your behalf
  • Discuss these with you before passing your information on to any prospective employer
  • Maintain regular contact with you throughout the whole recruitment cycle and beyond.
  • We will process your data in line with the General Data Protection Regulation and the DPA 2018
  • We will keep your information until you inform us otherwise

Off-Payroll Working in the Public Sector: Changes to IR35 from 6 April 2017

IR35 is the government’s tax legislation which focuses on identifying ’disguised employees‘. These are individuals providing services to a client through an intermediary company, such as a Personal Service Company (PSC). Their relationship with this client would be one of employment were it not for the presence of the intermediary. Where this is the case, IR35 rules require the intermediary to deduct and make payment of the equivalent employee-payable taxes.

If an assignment is managed by a Private Sector organisation and/or the contractor’s employment is with an Umbrella Company, then this legislation does not currently apply.

Responsibility for determining if an assignment is within IR35 has shifted from the PSC intermediary to the Public Sector organisation to which your PSC is supplying your services. Where IR35 rules apply, Intelligent Resource now calculates the applicable Tax and National Insurance Contributions and pay these directly to HMRC. The net payment that we then make to the PSC will reduce to reflect the amounts that must be paid by ourselves to HMRC.

Where it is decided by the Public Sector organisation that an assignment is outside IR35, no employment taxes will be payable by us to HMRC, therefore our payment to the PSC will be the gross amount invoiced.

If the assignment is ‘inside IR35’, we can offer the following engagement options for current and future assignments:

  • Move to an IR approved Umbrella Company model – There are many operating structures in the market and Intelligent Resource need to ensure the umbrella companies we engage with operate compliantly. The companies detailed in our approved umbrella list are FCSA accredited.
  • Continue to provide services through the PSC but subject to the necessary employment Tax and National Insurance Contributions made by Intelligent Resource.

To operate the new rules you must agree to be covered by our ‘VAT Self Billing’ arrangement so that the correct figures can be generated for your PSC invoices to us. You will need to register for VAT if you are not already.
